Terms and Conditions for The HaGuest Card members

The HaGuest Card BV is the founder of the The HaGuest Card programme. The following Terms and Conditions are applicable to this programme. By using the The HaGuest Card, you agree to the Terms and Conditions and the application of the Terms and Conditions.

1. Definitions
The Cardholder is an expat (expatriate) or the partner and/or children of an expat, who is temporarily employed by an international organisation, embassy or an international company in The Hague, and who has subscribed to The HaGuest Card.
The Company Participant can be any company or provider of a service, located in The Hague or its surroundings.
The HaGuest Card Programme consists of: The HaGuest Card, The HaGuest Guide, The HaGuest Card website, The HaGuest Card monthly digital newsletter, special events for the Cardholder and publicity campaigns.
The HaGuest Card. Every expat who is a participant of the The HaGuest Card programme receives the The HaGuest Card. By showing the card to the Company Participants, the Cardholder will receive special discounts and/or services.
The HaGuest Guide. This guide is published on a yearly basis and covers all company participants of the The HaGuest Card programme for that particular year.
The HaGuest Card Website. This website will be updated every week and contains information about company participants, special events, information about The Hague, useful tips and links. All of which can be found on www.thehaguestcard.nl.
Digital Newsletter. Every Cardholder will receive a digital newsletter on a monthly basis. The newsletter can be used for promotional purposes.
Special events can be organised by the Company Participants for The HaGuest Cardholders.
Publicity campaigns. Publicity campaigns will be held in order to promote The HaGuest Card.
The HaGuest Card Emblem: This emblem will be used to identify a Company Participant of the The HaGuest Card programme.

2. These Terms and Conditions are applicable to the The HaGuest Card programme and govern the relationship between the Cardholder of the The HaGuest Card programme and the founder of the The HaGuest Card programme: The HaGuest Card BV.

3. Subscription to the The HaGuest Card programme.
Expats can subscribe to the programme by way of an application form. The form will be received electronically or can be collected from the Personnel Department of their respective employer. The The HaGuest Card programme will offer Cardholders additional services, to which they can subscribe to by way of the application form. By subscribing to the programme, the participant agrees to all Terms and Conditions and the application of these terms and conditions.

4. Personal data.
Registration and administration of personal data will be administered in accordance with privacy legislation, governed by the Wet Bescherming Persoonsgegevens (Wbp). The personal data provided by Cardholders, will be stored in the The HaGuest Card database at The HaGuest Card BV. The HaGuest Card BV is the owner of this database and the sole party that will have access to the data. Database information will at no time be shared with any other parties. All personal information will be registered at the College Bescherming Persoonsgegevens in The Hague.

5. Goal of personal registration.
The Cardholder will provide The HaGuest Card BV with his/her personal data, by means of an application form. The data will be registered for purposes of market research, which will subsequently enable The HaGuest Card to better serve Cardholders.

6. The HaGuest Card.
There will be direct contact between the Cardholder and Company Participants by means of the The HaGuest Card. The The HaGuest Card is personal and not transferable. By showing The HaGuest Card to the Company Participant, the Cardholder will receive a special service or discount as previously organised by a Company Participant. All data will be stored in a database managed by The HaGuest Card.

7. Special services for Cardholders.
In order to participate in the The HaGuest Card programme, all Company Participants have agreed to provide each Cardholder with a special service and/or discount. The nature and validity of the offers will be determined by the Company Participants in agreement with The HaGuest Card. All special services and discounts will be published at www.thehaguestcard.nl. The HaGuest Card BV cannot be held responsible for any complaints concerning the services provided and the discounts offered by the company participants.

8. Responsibility regarding fraud.
The HaGuest Card BV cannot be held responsible for unauthorised use of The HaGuest Card. In the case of suspected fraud, The HaGuest Card BV reserves the right to end all special services and discounts made available through the The HaGuest Card programme.

9. The HaGuest Guide.
The HaGuest Card BV will publish the The HaGuest Guide on a yearly basis. This guide will provide information on Company Participants. It holds general information, information about its brands, contact details and locations. This guide will be sent to your home address once The HaGuest Card BV has received the completed application form. The HaGuest Card BV cannot be held responsible for any incorrect information published in the The HaGuest Guide.

10. The HaGuest Card website.
The website for The HaGuest Card will be updated on a weekly basis. It provides information about the Company Participants, about The Hague in general, will give tips, will be used for promotional purposes and provides useful information about other websites.

11. The HaGuest News.
Every Cardholder will have the opportunity to subscribe to a digital newsletter. The digital newsletter will be sent out once a month and will be used for promotional purposes as well as providing general information and tips.

12. The HaGuest Events.
Company Participants will have the opportunity to organise special events for The HaGuest Card Cardholders. The Cardholders are free to join these events. The HaGuest Card BV cannot be held responsible for any event which is not organised by The HaGuest Card BV.

13. Publicity campaigns.
The HaGuest Card BV will cooperate with Den Haag Marketing & Events to promote The HaGuest Card.

14. The HaGuest Card Logo.
A window logo will be used by the Company Participant in order to indicate their participation in the The HaGuest Card programme. The logo should be positioned in a visible place, in order for Cardholders to easily identify the Company Participant.

15. Selection procedure.
A special Selection Committee will oversee the selection process and review the product and/or services offered by each Company Participant interested in participating in the The HaGuest Card programme. A selection process has been put into place in order to meet the high standard of quality and service The HaGuest Card offers its Cardholders. This Committee will consist of representatives from organisations and companies where Cardholders are temporarily employed as well as representatives from the trade industry of The Hague.

16. Remarks and/or complaints.
In spite of the special attention we give to selecting Company Participants for participation in the The HaGuest Card programme (with the aid of a special Selection Committee), it could be possible that you are not satisfied with one of the services provided by one of the Company Participants. In any event of this we would appreciate your feedback and ask that you post your remarks and/or complaints in the comments forum specially provided for this purpose at www.thehaguestcard.nl. Additional remarks and/or complaints, can be posted through an online form at www.thehaguestcard.nl, or by post to:

17. Correspondence.
The Cardholders can communicate with The HaGuest Card BV, concerning the The HaGuest Card programme by way of an online form to be found at www.thehaguestcard.nl or by post to:

The HaGuest Card BV will communicate with the Cardholders directly by email or by post to the most recent address of the Cardholder. The HaGuest Card BV cannot be held responsible for any incorrect addresses or correspondence. A change in address or any other personal information changes of importance to The HaGuest Card BV can be communicated via post or by e-mail to: welcome@thehaguestcard.nl at The HaGuest Card BV.

18. Loss or theft
In case of loss or theft of the The HaGuest Card, please inform The HaGuest Card BV at once . Contact details can be found in 'contact info'. The Cardholder will be provided with a new card by The HaGuest Card BV within 5 working days.

19. Terminating The HaGuest Card programme.
The HaGuest Card BV reserves the right to terminate the The HaGuest Card programme completely at any time.

20. Cancelling your membership.
The Cardholder can end his/her participation in the program at any given time, by means of a written request to terminate membership, which should be sent to The HaGuest Card BV. As soon as The HaGuest Card BV receives this request, the card will be cancelled. The HaGuest Card BV furthermore requests that Cardholder inform The HaGuest Card BV when leaving The Netherlands permanently, so that the individual card may be cancelled and personal data deleted from the database. The card remains the property of The HaGuest Card BV and therefore must be returned to The HaGuest Card BV after the termination.

21. To conclude.
The HaGuest Card BV reserves the right to change the Terms and Conditions of the programme at any given time. The Cardholder and Company Participants will be given prior notice of changes. After changes are made, the previous Terms and Conditions will become invalid. Any dissensions will be presented to a qualified judge in Amsterdam. Dutch law is applicable to these Terms and Conditions and the The HaGuest Card programme.
